Late Wednesday afternoon, the Supreme Court rejected an attempt by Donald Trump to stop White House records being sent to a House committee to investigate the Capitol Riot of January 6.

Trump lost two attempts by lower federal courts against Trump to prevent the panel receiving more than 700 pages documents from National Archives.

He had unsuccessfully claimed in those courts that as an ex-president he could invoke executive privilege and prevent the disclosure of records.

For the records, President Joe Biden declined to invoke executive privilege.

The Supreme Court ruled Wednesday that the questions of whether or in which circumstances an ex-President may seek a court order prohibiting disclosure of confidential records during his term in office in face of the decision by the incumbent President, were unprecedented. This raises serious and significant concerns.

The court did note that U.S. Circuit Court of Appeals of the District of Columbia Circuit said that it had not been given the opportunity to resolve these issues because President Trump’s privilege claims were rejected “under any of its tests.” [he] advocated.”

The Supreme Court stated that “Because President Trump’s claims were not likely to succeed even if he was the incumbent”, the Court of Appeals had concluded.

Only Justice Clarence Thomas, out of nine Supreme Court justices would have approved Trump’s request for an injunction preventing the release records from the select committee.
