WASHINGTON, (Reuters) – The U.S. Supreme Court rejected Wednesday’s request by former President Donald Trump to stop the release White House documents requested by the Democratic-led congressional committee investigating the deadly attack last year on Capitol Hill by a mob led by his supporters.

This decision allows the disclosure of documents held by federal agencies that store historical and government records even if litigation continues below.

The decision was not opposed by any of the nine justices, except for Justice Clarence Thomas who is conservative.

Trump’s request to the justices came after the U.S. Court of Appeals for the District of Columbia Circuit on Dec. 9 ruled https://www.reuters.com/world/us/us-appeals-court-rejects-trumps-bid-withhold-records-panel-probing-jan-6-attack-2021-12-09 that the businessman-turned-politician had no basis to challenge President Joe Biden’s decision to allow the records to be handed over to the House of Representatives select committee.

The panel could be prevented from obtaining records if the court delays in disclosing the information. This committee hopes to conclude its work prior to the November congressional election in which Trump’s fellow Republicans hope to regain House Control. Republicans opposed the creation of the panel and may close the inquiry if the party wins a majority.

Trump and his aides have been fighting a legal battle to prevent access to witnesses and documents by the committee. Trump sought to invoke executive privilege which is a legal principle that protects confidential White House communications. This position was rejected by the lower courts.

A brief Supreme Court decision noted that it was not necessary to answer the question about whether former presidents can make an executive privilege claim to settle the case.

According to an unsigned order, “Because Trump’s claims would not have been denied even if the incumbent had prevailed,” said the court.
